Phoenix City Code Article I
Division 5 Section 2-22, Recovery of costs at events requiring
response by police.
A. If a Police Officer responds to a party, gathering or large event and while at the scene determines that there is a threat to the public peace, health, safety or general welfare, any person who is responsible for the party, gathering or event is liable for the reasonable costs of a response by the police to that incident
B. The costs of a response by the police shall be a charge against any person who is responsible for the party, gathering or event under this section. The charge constitutes a debt of that person and is collectible by the City in the same manner as in the case of an obligation under a contract. Costs imposed under this section are due and payable
upon the expiration of the period to request a hearing under subsection E or upon notice of the Hearing Officer’s decision if a hearing is requested. The liability imposed by this section is in addition to any liability otherwise imposed by the law.
C. In no event shall a person’s liability under this section for the costs of a response by the police exceed one thousand dollars for each incident. The costs of a response shall be waived if any person who is responsible for the party, gathering or event initiates a request for a police response and assists the police in dispersing persons attending the party,
gathering or event.
D. For purpose of this section, unless the context otherwise requires:
1. Reasonable costs include the salaries of the responding police officers, at the salary then in effect for each classification of each individual officer, for the amount of time actually spent in responding to or remaining at the party, gathering, or event; appropriate overhead; the actual cost of any medical treatment to injured officers; and the cost of repairing any damaged City equipment or property.
2. Party, gathering or event means a group of five or more persons who have assembled or are assembling in a manner which constitutes asubstantial disturbance of the quiet enjoyment of private or public property. This includes, but is not limited to, excessive noise or traffic, obstruction of public streets by crowds or vehicles, public drunkenness, the service of alcohol to underage persons, fights, disturbances of the peace and litter.
3. Person who is responsible for the party, gathering or event means any person in actual or
lawful control or possession of the premises, and any person who organized the party, gathering or event. If two or more persons are responsible for the party, gathering or event such persons shall be jointly and severally liable for the reasonable costs of a response. If the person responsible for the party, gathering or event is a minor, the parents or
guardian having custody or control of the minor shall be jointly and severally liable with such minor for the reasonable costs of a response.
E. Hearing Procedures:
1. A person liable for the costs of a police response under this section may, within ten days of receipt of notice of the costs imposed request a hearing with a Hearing Officer designated by the City Manager.
2. The Hearing Officer shall set a time and place for the hearing as soon as practicable.
3. The hearing shall be conducted in an informal process to determine whether there is a sufficient factual and legal basis to impose the costs of the police response and the reasonableness of the amount. The rules of evidence shall not apply, provided that the decision of the Hearing Officer shall in all cases be based upon substantial and reliable evidence. All parties to the hearing shall have the right to present evidence. The Police
Department shall have the burden of establishing by a preponderance of evidence that the costs of the police response should be imposed and that the amount is reasonable under the circumstances.
4. The decision of the Hearing Officer is final. A failure of the person charged with the costs of a police response to timely request a hearing or the failure to appear at a scheduled hearing shall constitute a waiver of the right to a hearing or to challenge the validity or amount of the costs imposed.

Capítulo 2, Artículo 1º, División 5. Sección 2-22
del código de la Ciudad de Phoenix, Recuperación de gastos por eventos que
requieren acción policial.
A. Si un agente de la policía responde a una fiesta, reunión o evento ruidoso y estando en la escena se determina que la actividad amenaza la tranquilidad, salud o el bienestar general del público, cualquier persona responsable por la fiesta será responsable por pagar el costo razonable por la acción policial.
B. De acuerdo a esta sección, el costo por acción policial debe ser cobrado a cualquier persona responsable por la fiesta, reunión o evento ruidoso. El cobro constituye que la deuda es de la persona y la Ciudad de Phoenix la cobrará de la misma manera
como se respeta la obligación de un contrato. El cobro impuesto de acuerdo a esta sección debe ser pagado cuando caduque la fecha limite para pedir una audiencia administrativa según el apartado E o la fecha que el oficial de la audiencia haya determinado que la persona responsable debe pagar el costo, en el caso que haya solicitado una audiencia administrativa. La responsabilidad impuesta por esta sección es adicional a cualquier otra responsabilidad impuesta por la ley.
C. En ningún caso debe una persona que es responsable por acción policial pagar más de mil dólares por cada incidente. El costo por acción policial no debe ser aplicado a una persona que es responsable por la fiesta, reunión o evento que llamó y ayudó a la
policía a dispersar a los presentes en la fiesta, reunión o evento.
D. Para el propósito de esta sección, a menos que el
contexto al contrario lo requiere:
1. El cobro razonable incluye los salarios de los agentes de la policía que respondieron a la llamada, basado en el tiempo que pasaron en el evento; los gastos generales apropiados; el costo actual por atención médica para los agentes de la policía heridos; y el costo para reparar equipo de la Ciudad.
2. Fiesta, reunión o evento significa cinco personas o más reunidas de una manera la cual constituye considerable disturbios a la tranquilidad residencial o pública. Esto incluye pero no se limita a tráfico o ruido excesivo, obstrucción de las vías públicas por grupos de gente o vehículos, ebriedad pública, el servir bebidas alcohólicas a menores de edad, peleas,
perturbación de la paz, y ensuciar la vía pública.
3. La persona que es responsable por la fiesta, reunión o evento es cualquier persona que tiene el control actual o legal de la propiedad y cualquier persona que organizó la fiesta, reunión o evento. Si dos o más personas son responsables por la fiesta, reunión o evento, ellas serán responsables por el costo razonable por la acción policial. Si la persona que
organizó la fiesta, reunión o evento es menor de edad, sus padres o tutores junto con el menor serán responsables por pagar el costo razonable por acción policial.
E. Procedimiento de audiencia.
1. La persona responsable por el costo de acción policial puede entregar una petición escrita para una audiencia administrativa con un oficial de audiencias designado por la administración del la ciudad de Phoenix dentro de 10 días desde que recibe la carta de
notificación de cobro por acción policial.
2. El oficial de audiencias deberá establecer la fecha,
la hora y el sitio de la audiencia tan pronto como sea práctico.
3. La audiencia debe conducirse en un proceso informal para determinar si hay suficiente argumento y base legal para imponer el cobro por acción policial y los costos son razonables. Las reglas en cuanto a la evidencia no deben aplicar, puesto que la decisión del
oficial de la audiencia debe en todos los casos basarse en pruebas substanciales y fiables. Todas las partes que participan en la audiencia tienen derecho a proporcionar evidencia. El departamento de policía debe hacerse cargo de establecer con preponderancia
de pruebas que el cobro por acción policial debe ser impuesto y que la suma a pagar es razonable de acuerdo a las circunstancias.
4. La decisión del oficial de la audiencia es final. Si la persona a quien se le impuso el costo por acción policial no pide una audiencia administrativa dentro del límite de tiempo o no se presenta a su audiencia anteriormente programada, renuncia su derecho a una
audiencia y de disputar la validez del caso o la cantidad del cobro impuesta.
